Summary of the contracting process

Torus62 Developments Limited is procuring a residential housing development on the former Huyton Cricket Club site in Huyton, Merseyside. The work covers delivery of the housing scheme and all associated works needed to complete it. This is a construction project for multi-dwelling buildings and individual houses, with the work taking place in Huyton. The development is intended to address local social housing need; the buyer cites long waiting lists and a lack of other suitable land available within a reasonable timeframe. The selected supplier is responsible for delivering the development as part of arrangements that include the land.

The procurement is complete and has been awarded to Breck Homes Limited. Torus62 used a direct award, on the grounds that technical reasons leave no reasonable alternative supplier: Breck Homes would sell the land only as part of arrangements that include its development, and the buyer says no other suitable land is available locally within a reasonable timeframe. The award is valued at £16,800,280 including VAT. The contract is due to run from 9 November 2026 to 31 October 2029, with a maximum extent date of 31 October 2030; it remains in force until the works are complete, with no fixed extension period stated. The scheduled contract signature date is 6 November 2026. The process was divided into one lot, marked as suitable for SMEs. No evaluation criteria are stated.

For suppliers considering similar future housing development work for Torus62 Developments Limited, this award shows the buyer has used a land-and-development arrangement to deliver social housing where local need is high and alternative sites are constrained. A credible competitor would need to secure or work with a landowner prepared to make the site available as part of a development package, and demonstrate the ability to deliver housing construction together with the associated works. The buyer’s stated rationale indicates that control of a suitable site and the ability to offer a practical alternative to the selected supplier’s land-and-development arrangement would be central to competing. The single lot was identified as suitable for SMEs, showing the buyer did not rule out smaller businesses, although the project requires delivery of a complete residential development.

Procurement Information

Torus62 Developments Limited is making a direct award under Section 41 of the PA 23 because a direct award justification applies and the Supplier is not an excluded supplier. Torus62 Developments Limited considers that the following conditions are met in relation to the public contract and therefore, the direct award justification set out in Schedule 5(6) of the PA23 can be relied on: a) due to an absence of competition for technical reasons, only a particular supplier can supply the goods, services or works required; and (b) there is no reasonable alternative to those goods, services or works. The reasons why Torus62 Limited considers that this direct award justification applies is because: (a) the Supplier is prepared to sell the land only as part of arrangements that also include its development. (b) Torus62 Developments Limited has significant unmet need in the locality of the development, evidenced through long housing waiting lists. (c) There is no other land on the market which is available for social housing development within reasonable timeframes local to the unmet need for development.
