Summary of the contracting process

Hampshire County Council plans to establish a Dynamic Market for the purchase of biodiversity net gain (BNG) units. These are habitat units registered with Natural England and made available for allocation by landowners or public bodies holding eligible units. The market is intended for public-sector buyers undertaking construction projects in England that need to purchase BNG units. It can be used by public authorities, private utilities, public undertakings and educational establishments across England. Hampshire County Council is setting up the arrangement, and public bodies may also participate as suppliers where they hold registered units. The activity is buying and selling registered biodiversity units, rather than construction or habitat-creation works themselves.

The process is at planning: Hampshire County Council has announced an intention to create the Dynamic Market, but has not yet invited applications to join. The Council expects to launch it around mid-November 2026. The planned market period runs from 23 November 2026 to 22 November 2036, with no defined end date stated for the market itself. The buyer expects to use an open procedure through a Dynamic Market. It is intended as a single arrangement and is marked as suitable for small and medium-sized businesses and voluntary, community and social enterprises. Public bodies wishing to use the market as buyers will need to enter an Access Agreement. The description says the market may be adjusted if procurement legislation changes to permit below-threshold procurements.

The arrangement is aimed at landowners with biodiversity net gain units registered with Natural England and available for allocation; public bodies holding such registered units may also register as suppliers. Suppliers should therefore be able to demonstrate that they hold eligible, registered units and can make them available to buyers undertaking construction projects in England. The buyer identifies the market as suitable for small and medium-sized businesses and voluntary, community and social enterprises, so smaller landowners and mission-led organisations may find it relevant if they hold qualifying units. Suppliers preparing to participate are advised to register on Hampshire County Council’s In-tend e-tendering system and on the Government Central Digital Platform. The intended buyers include a broad range of public-sector organisations, creating potential demand from construction programmes across England.

Notice Information

Notice Title

Dynamic Market for Bio-Diversity Net Gain Units

Notice Description

Hampshire County Council will be establishing a Dynamic Market for the purchase of Bio-Diversity Net Gain (BNG) Units. The Dynamic Market (DM), once open, will be seeking applications from Land Owners with BNG units registered with Natural England. In preparation to apply to join the Dynamic Market, Land Owners will need to register on the Council's e-tendering system (In-tend) by going to https://supplier.in-tend.co.uk/Hampshire/registration Land Owners will also need to be registered as a Supplier on the Government Central Digital Platform in order to take part in a public sector procurement process. To register please go to: https://supplierregistration.cabinetoffice.gov.uk/organisation/register The Dynamic Market will be open to all Contracting Authorities (as Buyers) as defined by the Procurement Act 2023, where the Authority is a Public Authority, Private Utility or where they are conducting a Public Undertaking as well as educational establishments. The DM will be designed for Contracting Authorities who are seeking to undertake construction builds in England and will therefore need to purchase BNG units. Public bodies in England (e.g. such as Hampshire County Council itself) will also be able to register as a supplier on the DM, as a holder of registered BNG units which are available for allocation. It is envisaged the Dynamic Market will be launched around Mid-November 2026. Public bodies wishing to use the Dynamic Market as a Buyer will be subject to an Access Agreement. The Dynamic Market will commence on the commencement date and will be subject to reviews to ensure it remains compliant with relevant procurement legislation, but it will not have a defined end date. Whilst we recognise that currently the Procurement Act 2023 only allows for above threshold procurements via a Dynamic Market, should the legislation change to allow for below threshold procurements, this DM will be modified accordingly.
