Under Regulation Reg 6(1)(b)(ii) of the Procurement (Scotland) Regulations 2016, a contracting authority may award a contract without competition based on following justification: Competition is absent for technical reasons (only if it is not caused by artificial narrowing down of the parameters of the procurement and no reasonable alternative or substitute exists). The consumables are being purchased for use with equipment where compatibility and continuity of output is essential. This is a highly specialised procedure of human ovum harvest, the manipulation of the human ova and the replacement of the embryo. The consumables are designed to be used with existing equipment. For this reason, competition is absent for technical reasons.
