West Lothian Council have a need for registered residential care and require to continue to purchase 8 residential care beds at 2 The Steadings, Humbie Farm, Kirknewton EH27 8DS, whilst an ongoing review of registered residential care by the Council's Senior Management Team progresses. As the full impact of COVID 19 is unknown in terms of both West Lothian's workforce and the provider, to ensure continuity of care for service users during this period, it is proposed that a direct award is made to the incumbent service provider for a period of 12 months.. Whilst the contract value since commencement is estimated at GBP 2,372,318 the estimated contract value for the 12 month period is GBP 412,577

Procurement Information

The Council needs to respond immediately to the ongoing COVID-19 consequences with council staff for example being diverted from their normal duties. The events that have led to the need for extreme urgency were unforeseeable and could not have been predicted by a reasonably diligent Authority. The present situation is not attributable to the contracting authority in any way and with council staff employed in other capacities it is not possible to comply with the usual timescales in the 2015 Regulations. There is also no known available framework whereby a call off contract under an existing commercial agreement such as a framework or dynamic purchasing system could be undertaken. The Authority perceive that the extreme urgency factors within Section 33 of the Public Contracts (Scotland) Regulations 2015 have been met and with a duty to ensure that there is service provision for vulnerable persons,and to ensure that care is provided within West Lothian it is proposed that a direct award is made for a period of 12 months as the full impact of COVID 19 is unknown in terms of both our own workforce and that of service providers. This will allow time for future contract arrangements to be put in place.
