In light of present Covid 19 situation a direct award of 12 months to the current incumbent providers to facilitate the completion of the service redesign, its associated service specification and consultation with customers and partners.

Lot 1

Extension of present contractual arrangements for a period of 12 months to provide Supported Accommodation to Adults' Mental Health and Substance Misuse care groups. With the extent of the present Covid 19 situation still unknown, the extension of the contract for a further 12 month period, will enable the informed development of more progressive provision and contracts for Accommodation with Support. This will deliver better outcomes, align with national well-being and Integrated Joint Board indicators, while offering a more effective and efficient service.. Whilst the estimated contract value to date including the proposed extension is GBP 10,976,560 the estimated value of the proposed extension is GBP 1,568,080.

Procurement Information

The Council needs to respond immediately to the ongoing COVID-19 consequences with council staff for example being diverted from their normal duties. The events that have led to the need for extreme urgency were unforeseeable and could not have been predicted by a reasonably diligent Authority. The present situation is not attributable to the Contracting Authority in any way and with council staff employed in other capacities it is not possible to comply with the usual timescales in the 2015 Regulations. There is also no known available framework whereby a call off contract under an existing commercial agreement such as a framework or dynamic purchasing system could be undertaken. The Authority perceive that the extreme urgency factors within Section 33 of the Public Contracts (Scotland) Regulations 2015 have been met and with a duty to ensure that there is service provision for vulnerable persons,and to ensure that care is provided within West Lothian it is proposed that a direct award is made for a period of 12 months as the full impact of COVID 19 is unknown in terms of both our own workforce and that of service providers. This will allow time for future contract arrangements to be put in place i.e. the completion of the service redesign, its associated service specification and consultation with customers and partners.
