A direct award is proposed to the incumbent provider in light of the present Covid 19 pandemic to ensure that the Council has Supported Living Services to tenants in separate properties at Bathgate and Uphall Station.

Lot 1

To make a direct award for supported living services to 8 adults with profound and moderate learning disabilities with high support needs based in two locations in West Lothian: Gideon Street, Bathgate EH48 4HD (premises owned by Barony Housing Association) and Pumpherston Road, Uphall Station which is owned by the incumbent provider. A direct award of 7 months is sought to ensure continuity of care for vulnerable service users during the present Covid 19 pandemic.. Although the estimated total value including the proposed contract extension is GBP 1,209,030 the estimated value of the proposed extension is GBP 301,070

Procurement Information

The Council needs to respond immediately to the ongoing COVID-19 consequences with staff for example being diverted from their normal duties. The events that have led to the need for extreme urgency were unforeseeable and could not have been predicted by a reasonable diligent Authority. The present situation is not attributable to the contracting authority in any way and with council staff employed in other capacities it is not possible to comply with the usual timescales in the 2015 Regulations. There is also no known available framework whereby a call off contract under an existing commercial agreement such as a framework or dynamic purchasing system could be undertaken. The Council therefore perceive that the extreme urgency factors within Section 33 of the Public Contracts (Scotland) Regulations 2015 have been met and with a duty to ensure that there is service provision for vulnerable persons, it is proposed that a direct award is made for a period of seven months as the full impact of COVID 19 is unknown in terms of both our own workforce and that of service providers. This will allow time for tendering activity to re-commence.
