Summary of the contracting process

The procurement process involves West Lothian Council, which has awarded a contract titled "LD Close Care And Support Blackburnhall Gardens Service." This service, located in Livingston, England, is part of the public services industry and aims to provide close care for individuals with learning disabilities and complex health needs. The procurement method was a limited tender, conducted as a direct award due to the urgent needs arising from the COVID-19 pandemic. The contract was signed on 29 May 2020, with an active status and a total value of £198,831. It specifically addresses the need for one-to-one care support for two male adults within Blackburnhall Gardens, Bathgate, operating under extreme urgency circumstances.

This tender presents significant growth opportunities for businesses, particularly those offering specialised care services for individuals with disabilities and complex health needs. Companies with experience in providing social care or healthcare support services, especially those familiar with emergency operations and adapting to urgent demands, would be well-suited to participate in such contracts. The limited nature of the procurement process suggests that there may be further opportunities for providers capable of demonstrating their ability to meet ongoing care requirements in a challenging context, which is crucial as the impact of the pandemic continues to evolve.

Procurement Information

The Council needs to respond immediately to the ongoing COVID-19 consequences with staff for example being diverted from their normal duties and the events that have led to the need for extreme urgency were unforeseeable and could not have been predicted. The present situation is not attributable to the contracting authority in any way and as with council staff employed in other capacities it is not possible to comply with the usual timescales in the 2015 Regulations. There is also no known available framework whereby a call off contract under an existing commercial agreement such as a framework or dynamic purchasing system could be undertaken. The Council therefore perceive that the extreme urgency factors within Section 33 of the Public Contracts (Scotland) Regulations 2015 have been met and with a duty to ensure that there is service provision for vulnerable persons, it is proposed that a direct award is made for a period of six months as the full impact of COVID 19 is unknown in terms of both our own workforce and that of service providers. This will allow time for tendering activity.
