Embryoscope Incubator for use at Aberdeen Fertility Centre. Award of a contract without prior publication of a call for competition. Justification for selected award procedure: The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons Explanation Under Regulation 33 (1) (b) (ii) of the Public Contracts (Scotland) Regulations 2015, a contracting authority may use the negotiated procedure without the prior publication in the case of a public contract, based on the following justification: A contracting authority may award a public contract following negotiated procedure without prior publication of a contract notice or prior information notice in any of the following cases-- (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons-- (ii) competition is absent for technical reasons; This is specialised piece of equipment. The incubator is a critical piece of equipment which enables a stable environment for the culture of gametes and embryos. The incubator has to have very tight temperature regulation and correct gas environment otherwise this would be detrimental on embryo development and impact on patient success rates. We already have two of these incubators in the laboratory but to be able to ensure that all patients gametes/embryos can be cultured in these specialised incubators we need to purchase another. As we are governed by the HFEA which is our regulatory body there are specific requirements for any equipment we purchase, and this incubator fulfils these requirements. The equipment also needs to fulfil the ISO requirements which this specialised incubator does. All incubators used for culture need to be connected to an emergency call system in cases of any failure and as we already have a couple of these in situ we therefore have a company we can use to supply a monitoring probe which is compatible to these specialised incubators.
