Scottish Fire and Rescue Service (SFRS) has a statutory duty, under the Fire (Scotland) 2005 Act to make provisions in relation to fire fighting and a range of other emergencies including road traffic collisions, flooding, search and rescue, chemical, biological, radiological and nuclear incidents, as well as having the power to respond to other incidents at its discretion SFRS currently operate four Hapsite chemical identification systems as part of the Detection, Identification and Monitoring (DIM) capability. This equipment was originally provided to legacy services by Scottish Government under the New Dimensions project, and this equipment forms part of the national resilience Chemical, Biological, Radiological and Nuclear defence (CBRN) and local hazmat capability inventory. The Hapsite Systems are used to identify substances involved in Hazmat/CBRN Incidents and they must be kept available for CBRN/Hazmat incidents within Scotland as well as for any Mutual Aid requests from any other FRS's at a UK level. The original maintenance contract was established by the Scottish Government as part of the New Dimensions Project and was awarded to Inficon Ltd who are the sole provider of the required Preventative Maintenance and Performance Testing Services that are required. SFRS propose to award a contract to Inficon for a period of three years with the option to extend by a further one-year period. Procuring these services will ensure that there is no compromise in mutual-aid agreements with the wider UK Fire and Rescue Services thereby ensuring that the cross-border response to Chemical, Biological, Radiological and Nuclear (CBRN) incidents is not compromised. Procuring these services will allow SFRS to continue to observe National Operational Guidelines (NOG) for UK National Resilience arrangements.

Procurement Information

SFRS has a statutory duty under Part 2 of the Fire (Scotland) Act 2005 (FSA 2005) to respond to fire and road traffic incidents and a power to respond to other events and situations. The Fire (Additional Function) (Scotland) Order 2005 (F(AF)SO 2005) sets out situations or events that SFRS has a statutory duty to respond to including Chemical, Biological, Radiological and Nuclear (CBRN), Search and Rescue, severe flooding and serious transport incidents. Section 13 of the FSA 2005 implores SFRS to take any action that it sees as appropriate in response to a situation that causes or is likely to cause death or serious injury to a person or harm to the environment including the power to secure the provision of equipment. Both the FSA 2005 and the F(AF)SO 2005 detail that SFRS has a responsibility to enter into a reinforcement scheme with other relevant authorities to secure mutual assistance for the purpose of carrying out the duties and functions previously detailed. The Civil Contingencies Act 2004 requires SFRS to work with other emergency services and responders in producing comprehensive plans for major and catastrophic incidents including emergency planning and response to widespread threats and incidents involving terrorism or environmental disasters.

        "reviewDetails": "The Scottish Fire and Rescue Service (SFRS) must, by notice in writing as soon as possible after the decision has been made, inform all tenderers and candidates of its decision to award the contract, conclude the framework agreement or establish a dynamic purchasing system. The SFRS will incorporate a minimum 10 calendar day standstill at the point information on the contract award is communicated to tenderers. The SFRS is obliged to comply with the regulations and any eligible economic operator can bring an action in the Sheriff Court or the Court of Session where as a consequence of a breach by the SFRS, they suffer or risk suffering loss or damage. The bringing of court proceedings during the standstill period means that the SFRS must not enter into the contract, conclude the framework agreement or establish the dynamic purchasing system unless the proceedings are determined, discontinued or disposed of: or the court, by interim order, brings to an end the prohibition. The bringing of court proceedings after the standstill period has elapsed and the remedies that are available to the courts are detailed in the regulations.",
