The Public Contracts (Scotland) Regulations 2015 and Procurement (Scotland) Regulations 2016 make provision for direct award of contract in certain limited circumstances. Regulation 6 of the 2016 regulations and regulation 33 of the 2015 regulations provide that a contracting authority may award a public contract without going to the market where (but only if it is strictly necessary) for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for competitive procedure cannot be complied with and the authority considers it must proceed to award a contract without delay.
