Supported Living Services for Adults with Complex Care Needs. Economic operators may be excluded from contracting with the Council if they are in any of the situations referred to in Regulation 58 of the Public Contracts (Scotland) Regulations 2015. Information on this will be collected during prequalification and annually during the contract term.

Procurement Information

Regulation 76 of the Public Contracts (Scotland) Regulations 2015 allows a contracting authority to determine the procedure that is to be applied in connection with the award of a contract and may take account of the specialties of the services in question and the requirements and needs of users In this case, no prior notice has been issued on the basis that there are sufficient technical reasons to allow the direct award. These technical reasons relate to the specialties of the service and the requirement for continuity of service to meet outcomes for service users. The decision was made to award contracts to existing providers, who will pre-qualify to the resource of qualified providers. There will be no artificial narrowing of the market as new providers can complete our pre-qualification process and be included in our resource of qualified providers.
