A negotiated procedure was conducted in accordance with Regulation 6 (1)(b)(ii) The Procurement (Scotland) Regulations 2016 which states "Circumstances in which a contract can be awarded without competition 6.(1)A contracting authority may award a public contract without seeking offers in relation to the proposed contract-- (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons-- (i) competition is absent for technical reasons; but only, in the case of paragraphs (ii) and (iii), where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
Procurement Information
As the Council have been working with Hennessy IT Consulting Limited since 2018 to implement the ERP system and to get ad hoc technical advice over the years, no other supplier will have the internal knowledge of the Council's processes and the work it has done to date to implement the system, as well as the technical expertise of the Unit 4 Business World system to give adequate advice within the tight timescales for delivery of the new module.
