Upgrade of the bespoke Marine Simulator research facility at NDC.

Procurement Information

The grounds for justification of awarding this contract without seeking offers through a formal procurement procedure is that competition is absent for technical reasons. Under clause 33 (1)(b)(ii) of the legislation, a contracting authority may award a contract without competition (only where no reasonable alternative or substitute exists, and the absence of competition is not the result of artificial narrowing down of parameters of the procurement). In this case, the grounds for not exposing to competition are as follows: Technical exclusivity & IP dependencies The simulator's architecture and control stack are proprietary to OSC. Hardware selection must conform to OSC's bespoke specifications and closed interfaces to prevent malfunction, data integrity issues, or loss of certification. Third parties do not have access to OSC's proprietary protocols, source code, or detailed design artifacts required to safely and correctly integrate hardware and recalibrate the simulator. Warranty, accreditation & system assurance Upgrades performed by non-authorized vendors may void warranties, breach license conditions, or jeopardize accreditation/validation status. OSC is the only supplier able to guarantee conformance and maintain the assurance case.
