CMAL intends to award a contract for Designer and Principal Designer services in connection with the Ardrossan Harbour Redevelopment Project following a further competition conducted under Lot 7 of the Scotland Excel Engineering and Technical Consultancy Framework Agreement (Ref. 1025). A capability and capacity assessment was undertaken across suppliers appointed to the relevant Framework lot. Suppliers assessed as capable of delivering the requirement were invited to participate in a further competition through PCS-Tender. Tenders were evaluated in accordance with the published award criteria and weightings, and Wallace Stone achieved the highest overall score and has been identified as the preferred bidder. CMAL is procuring these services in connection with activities that fall within the scope of the Utilities Contracts (Scotland) Regulations 2016 ("UCR"). The Scotland Excel Framework was established under the Public Contracts (Scotland) Regulations 2015 ("PCR"). CMAL has obtained legal advice regarding the use of the Framework for this requirement. CMAL considers that: - CMAL is entitled to access and use the Framework as an authorised user; - the services required fall within the scope of the Framework and the relevant lot; - the Framework was established through a transparent and competitive procurement process; and - the further competition has provided a fair and competitive opportunity to capable Framework suppliers. CMAL acknowledges that use of a Framework established under PCR for a requirement falling within UCR may give rise to an arguable technical procurement risk. However, having regard to the competitive process used to establish the Framework, CMAL's entitlement to use it, the scope alignment of the services, and the competitive further competition undertaken, CMAL considers there to be a reasonable and proportionate basis for proceeding with the proposed award. CMAL is therefore publishing this VEAT notice in the interests of transparency and intends to conclude the contract following expiry of a voluntary standstill period, provided no successful challenge is received.
