Summary of the contracting process

Registers of Scotland buys secure mail delivery and collection across Scotland. The service carries legal documents for solicitors and agents, so secure handling is central to the requirement. Next-day delivery is essential to meet the buyer’s obligations to its customers, and occasional tracked-mail service must also be available. The delivery location recorded for the requirement is Registers of Scotland’s address at 153 London Road, Edinburgh; the service itself covers Scotland. This is a specialist postal and courier service, rather than general mail handling: suppliers need to manage secure items and provide dependable next-day delivery across the required area.

The procurement is complete and the contract is active. Registers of Scotland selected Dx Group Ltd through a limited procedure without a prior competition, on the stated basis that DX was considered the only provider able to deliver the required service in Scotland; the buyer said Royal Mail could not guarantee next-day delivery. The contract was signed on 26 September 2024 and is valued at £78,036.67. The award relates to a single lot covering secure mail delivery, including next-day delivery. The procurement records do not give an award date or a contract start or end date, so the length of the contract cannot be established from the stated terms.

This award demonstrates demand from Registers of Scotland for a secure, Scotland-wide service handling legal correspondence for solicitors and agents. A credible competitor when this requirement next reaches the market would need to show secure custody and delivery of sensitive legal documents, dependable next-day performance across Scotland, and the ability to provide tracking when required. Nationwide postal reach alone may not be enough: the buyer’s stated reason for using a limited procedure was that it believed only DX could meet the service requirement, and that Royal Mail could not guarantee next-day delivery. Suppliers would therefore need evidence of delivery coverage, operational capacity and performance against next-day commitments, as well as processes suitable for secure items.

RoS - Secure Mail Delivery

Notice Description

Secure Mail delivery and collection throughout Scotland. Next day delivery is imperative due to our obligations to our customers. Tracked mail is also an option we use occasionally and must be available.

Lot Information

Lot 1

We are looking to put a contract in place for a secure mail delivery service encompassing next day delivery for Registers of Scotland. We have an obligation to deliver to a number of solicitors and agents and often contain legal documentation.

Procurement Information

We believe that there is only 1 company who can provide the service that we require within Scotland and that would be DX. Legal Post used to offer a similar service but were bought by DX and now they hold a monopoly on this service. We use Royal Mail for other services but they cannot guarantee next day delivery for example.
