HMCTS Reform Evaluation Vulnerability Deep Dive
Notice Description
This study forms part of the HMCTS Reform Overarching Evaluation programme. This programme is assessing the implementation of reform and whether it has met its objectives, with a focus on Access to Justice related outcomes. The effect and experience of reform on vulnerable individuals is a particular area of interest among key stakeholders, including Parliamentary Select Committees and the judiciary. Other evaluation activity currently already undertaken/planned will include particularly vulnerable users, but these are likely to form only a small proportion of participants and will not include those with legal problems who don't access justice services. This study is a significant component of the overarching evaluation of HMCTS reform. It aims to understand the experience of the reform programme by the most vulnerable groups, including those who do not access the formal justice system. Information gathered will be used to identify where improvements can be made to reformed services. This study will further develop a robust evidence base to assess the implementation, delivery, and impact of the reform programme. There is significant interest in the evaluation from a wide range of groups and stakeholders which will be considered throughout. The NAO recommended that HMCTS should address how it will identify and evaluate the impact of changes on people's access to, and the fairness of, the justice system, particularly in relation to those who are vulnerable and digitally excluded members of the public. In response, the HMCTS Reform Evaluation Framework was published in May 2021. This framework includes the individual and cross-cutting research projects, including an in depth study on reform and vulnerability. We are expected to provide updates to the PAC on progress with the evaluation. Other interested parties include: the judiciary, the Justice Select Committee, the Constitution Committee, the academic community and third sector organisations. Additionally, HMT Spending Review conditions involve building an evidence base. This study will play an integral part in doing so as part of our overarching evaluation.
