Notice Description
To procure an open source, integrated platform that could provide both website and forms capability. The service will be procured by the London Borough of Sutton on behalf of the London Borough of Sutton and the Royal Borough of Kingston.

Our Digital Service consists of two components: Content Management System (CMS) which is our website FORMS functionality which underpin our digital services (such as 'Report Fly Tipping') we use a Forms platform Within the last 12 months, a detailed review of our CMS and FORMS platform was carried out by Digital & IT and independently reviewed by an impartial 3rd Party (FutureGov). The conclusion was that the existing CMS & FORMS are no longer suitable for our needs. The technology for the Digital Services has also changed over the years and the functionalities can now be replaced with a single Digital Experience Platform (DXP) product. We have therefore completed a review of the DXP market focussing on the underlying technology. The team will procure an open source, integrated platform that could provide both website and forms capability. Our market review identified Liferay as the preferred technology platform and from our assessment of the G-Cloud marketplace for liferay, provider Placecube is best placed to satisfy our current and future needs. The report recommends that a Direct Award with Placecube be used to procure the desired service under the Negotiated Procedure (without prior publication) The service will be procured by the London Borough of Sutton on behalf of the London Borough of Sutton and the Royal Borough of Kingston.
Procurement Information
London Borough of Sutton have made a direct award to the provider of Digital XP technology in which a technology duopoly exists between Liferay and Aquia. London Borough of Sutton have appraised both technologies during a 'play day' and Liferay has emerged the only technology capable of meeting the Council's technical requirements. The solution provided by Liferay is a 'core requirement' of the Council's new digital platform. This question was considered in the case of Commission v Italy Case 199/85, where the ECJ confirmed that it was insufficient to demonstrate that a particular provider was able to produce the most efficient performance;it was required to show that only that provider could produce what was required.
