The Royal Parks (TRP Trading Company Ltd) invited tenders for an event contract for the operation and management of Hyde Park Music Festival for a six year period. The contract was subsequently modified to include two additional event slots ("Additional Events") for the years 2022-2024 due to these event slots becoming unexpectedly available and the charity not having the necessary time available to undertake a procurement exercise. "description": "TRP publishes this notice to record its intention to modify its contract for the operation and management of Hyde Park Music Festival (HPMF) to allow the Event Organiser to hold Additional Events (AEs) in 2025, 2026 & 2027, each having a capacity of 49,999. All of the events permissible each year under the contract (including the Additional Events) will be held within a three-week time period in June and July each year as an extension to the existing HPMF contract. It is considered that separation of the AEs into a separate contract would have a detrimental impact on the park and the access to it, and enjoyment of it, by its estimated 12.8m visitors per annum.",
"rationale": "Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee: This is an Event Services contract, classified as 'social and other specific services' under Schedule 3 of the CCR. As such, TRP does not consider Regulation 43 of the CCR applies. Additional Events (AEs) have become available because a concession contract for an event in September expired during the Covid pandemic. The cost of staging a smaller standalone event in September substantially outweighs the inclusion of the AEs in the HPMF Contract for 2025-27. Instead of 2 lots of event infrastructure being built and de-rigged and 2 lots of concerts - as was the previous arrangement when the 2 slots that are now the AEs were previously used for different events in September - there is only 1 event, 1 lot of infrastructure and 1 lot of disruption - significantly better for the park environment and the enjoyment of the park by its visitors. The modification is also necessary as there is no time to procure an alternative event organiser (under a separate contract) to hold the AEs from 2025."
