Summary of the contracting process

Herefordshire Council has established a framework for alternative education for children and young people for whom it has statutory responsibility, including those without a school place, unable to access a suitable individualised education package, at risk of or permanently excluded, or medically unable to attend school. Services are delivered in Herefordshire. The framework covers three service areas: education and engagement activities; face-to-face and/or online mentoring; and face-to-face and/or online tuition. Providers may deliver in one or more areas, with multiple providers appointed to each. This is education and training provision, intended to meet individual needs through appropriate placements and learning support.

The open-procedure procurement under the Procurement Act 2023 has been awarded and contracts are active. Awards were made on 27 March 2026; contracts commenced on 1 July 2026, run to 30 June 2028, and may be extended to 30 June 2033, subject to demand and governance. The framework’s maximum value is £20 million excluding VAT across all three areas. Lot 1 covers education and engagement, with six providers appointed; Lot 2 mentoring, with 14; and Lot 3 tuition, with 12. The same providers may appear in more than one lot. The council used pass/fail quality assessment. The framework allows placements to be allocated without competition using specified selection factors, or through mini-competitions. The awards include Fuzzypegs Ltd, Hereford Community Farm CIC, Lower Bush Farm CIC, Proactive Adventure Ltd, Stride Active (Herefordshire) CIC, Skylark Adventures Ltd and numerous other providers.

This framework demonstrates recurring council demand for individualised alternative education, spanning engagement activities, mentoring and tuition rather than a single delivery model. Providers competing when the framework reopens will need to show they can deliver one or more of these services to children and young people with varied circumstances, including school exclusion, lack of a school place or medical absence. The appointed provider base includes education and tutoring businesses, recruitment and provision organisations, community-interest companies, farms and activity providers; both SMEs and larger suppliers are represented. Credibility will depend on demonstrable service quality meeting the pass/fail threshold, and the practical ability to match provision to a young person’s needs, location, schedule, urgency and available capacity. For individual placements, the council may also consider price and family or young-person choice.

Herefordshire Council has established an Open Framework of suitably qualified providers to deliver alternative education for those children and young people for whom it has a statutory responsibility, who are without a school place; or where a maintained school or academy has been unable to fully provide an appropriate individualised education package. Alternative provision may also be put in place for students who are at the point of permanent exclusion, have been permanently excluded from school or signed off from school on medical grounds. The Alternative Education Provision Framework contains 3 Lots: * Lot 1 - Education and engagement activities * Lot 2 - Mentoring (face to face and/or online) * Lot 3 - Tuition (face to face and/or online) Providers have been appointed to one or more Lots depending upon the service(s) they are able to offer. Multiple providers have been appointed under each Lot. In accordance with the PA 2023, the Council will re-open the Open Framework at least once before the third anniversary of the First Open Framework Commencement Date and at least once every five years thereafter. Further providers may be appointed to the Open Framework when it is re-opened in accordance with the Procurement Act 2023 and the Framework terms. The maximum total value of this framework is PS20,000,000 (ex VAT) across all 3 Lots. The procurement was conducted in accordance with the open procedure under the Procurement Act 2023. It was carried out under the Light Touch Regime (LTR) permissible under PA 2023, Section 9, and therefore applied the flexibilities afforded under the above provisions. Note regarding contract execution dates: The Framework commenced on 1 July 2026. Due to the volume of individual Framework Agreements, these were formally executed between 2 July 2026 and 3 August 2026. The "Date signed" field shows 1 July 2026 due to system constraints within the publication platform and does not represent the actual execution dates.

Planning Information

Herefordshire Council will be running a Market Engagement event for all businesses interested in delivering Alternative Education Provision for children and young people in Herefordshire. The event will be on 17th June 2:00pm - 3:00pm via Microsoft teams. The event will cover a range of topics including information of where to find council opportunities, how to successfully bid for them and specific information about this project along with opportunities to ask questions and network. ALL SUPPLIERS WHO WISH TO ATTEND WOULD NEED TO EXPRESS THEIR INTEREST by 4:00pm on Monday 16th June and confirm the name and email address that we should send the Microsoft Teams invitation to.
