Legal Support - Renewable Energy Development
Notice Description
You are invited to tender for a framework agreement to provide Forestry England with legal services in connection with Renewable Energy developments (notably wind energy developments) across the Nation's Forests. For full details of our needs, please read the separate specification document. Renewable development presents a new strategic opportunity for Forestry England which will require Forestry England, acting on behalf of the Secretary of State, to enter into a range of complex legal agreements including partnerships with other developers and relevant stakeholders. Renewable energy development is a highly specialist area, it therefore necessitates access to legal advisers with specific expertise and experience in this sector to ensure appropriate risk management and compliance throughout the development lifecycle.

"description": "Orders will be carried out in accordance with the hourly rates or fixed fee pricing that is put forward as part of the Supplier's tender. Each Order must include a fee estimate or agreed fixed fee, together with any anticipated disbursements, all of which must be set out in a Order scope and approved by the Commission before any work commences. All Orders are direct awarded following the awards without re-opening competition process defined in Framework Agreement Clause 4.2. The Supplier will provide pre instruction advice at Associate level to support initial discussions and help determine necessary actions before any formal Order is agreed. Where the first-ranked Supplier on the relevant framework lot: * has a conflict of interest; * is unable to meet a specific Order requirement due to insufficient knowledge or expertise; * is unable to or does not provide pre-instruction advice or submit a quotation within the required timescales; * is unable to deliver the services within the timescales required in the Order; * does not submit a quotation in accordance with the Framework Price List; * or declines to quote, the Commission will offer the opportunity to the next-ranked Supplier following the process above. This process will continue sequentially through all four Suppliers appointed to the framework. Where none of the appointed Suppliers are able to meet the requirement, the Commission reserves the right to procure the services outside of the framework."
