Notice Information
Notice Title
Provision of a Cicso Enterprise Agreement
Notice Description
The Council wish to procure a Cisco Enterprise Agreement as a flexible 5-year program that will consolidate the council's software licenses, subscriptions, and services across the Councils entire infrastructure into one contract. The aim over cost saving is to simplify the management of our estate of Cisco licences with co-terminated licenses, provides predictable pricing, and allows for growth. The Key features and benefits the council expect from a Cisco EA include: * Simplified Management: Combines multiple licences, renewals, and support contracts into a single agreement with one, unified, co-terminated date. * Flexibility & Growth: Includes "True Forward" terms, allowing organisations to deploy software and add users or licences immediately midterm, with payments adjusted only annually. Equally licences can be moved from one device to another. * Cost Control: Provides predictable, fixed pricing on better EA discount rates compared to buying individual licences and built in growth allowances * Visibility: Offers a centralised dashboard for licence management and to track and manage software usage.

"noEngagementNoticeRationale": "In accordance with the Procurement Act 2023, the Council has not undertaken pre-market engagement as this procurement relates to a straightforward enterprise agreement for standard, commercially available software. The requirement is clearly defined and concerns off-the-shelf software provided under an established licensing model within a mature and well-understood market. There is no bespoke development, technical complexity, or innovation requiring early supplier input. Pre-market engagement is discretionary under the Act and is not considered necessary where it would not materially improve competition, specification design, or value for money. In this case, undertaking such engagement would be disproportionate to the nature and scale of the requirement. The Council is therefore satisfied that proceeding without pre-market engagement is proportionate and compliant with the Procurement Act 2023."

Suppliers should note that there will be no negotiations permitted on the Contract Cover Sheet (Appendix C) prior to or after the Tender submission deadline date. Suppliers are deemed to accept the Contract Cover Sheet and able to supply the terms that apply to the Cisco Enterprise Agreement as set out in this document and the Council reserves the right to reject a Tender which seeks to vary or qualify the terms of the Contract (in a manner not permitted in this document). The potential risks include the requirement to increase the Council's estate of licence requirements arising from: a) impacts resulting directly from decisions taken in relation to Local Government Reorganisation, including the addition of new sites to the existing network or the assumption of responsibility for separate networks coming under Council management; and b) changes to network design that necessitate different licence types, including those associated with alternative models of network equipment There is also a risk that Cisco may withdraw, or make substantial changes to, its Enterprise Agreement model during the term of the Contract, resulting in the existing arrangement becoming obsolete and requiring migration to a replacement agreement or revised model."
