Notice Description

We wish to award a contract to National Gas Transmission for diversion of gas mains to allow construction of the West Winch Housing Access Road. We are using this process as only this supplier can work on their own gas main.

The justification is Schedule 5 Paragraph 5 of Procurement Act 2023. 5. The following conditions are met in relation to the public contract- (a) due to a particular supplier having intellectual property rights or other exclusive rights, only that supplier can supply the goods, services or works required, and (b) there are no reasonable alternatives to those goods, services or works. We are using this process as only this supplier can work on their own gas main. (a) as owner of the asset, the supplier has the exclusive right to undertake works on it, and (b) it is necessary to divert the apparatus in order to be able to construct the road.
