Contract Variation to an existing agreement - Current contract still has 7 years of the contract term remaining - variation is to move to a agency model This modification is to be made in accordance with regulation 43(1)(e) of the Concession Contracts Regulation 2016, namely that the modification is not substantial. A substantial modification is defined under regulation 43(9) of the Concession Contracts Regulations 2016. With regard to regulation 43(9), The Council notes the modification: 1) does not render the concession contract materially different in character from the one initially concluded; 2) does not allow for the admission of other participants, allowed for the acceptance of another tender, or attracted additional participants in the procurement procedure initially conducted; 3) does not shift the economic balance of the contract in favour of the concessionaire in a manner not provided for in the initial contract; 4) does not extend the scope of the concession contract considerably; and 5) does not replace the concessionaire initially awarded the concession contract.
