Summary of the contracting process

Gloucestershire County Council procured a legal case management system with court-bundling capability. The software manages legal case information and court documents, and is integrated with the Council’s ICT systems so legal documents can be stored securely. The requirement is for a connected system supporting the Council’s legal work, including court and quasi-judicial processes. The buying organisation is Gloucestershire County Council, and delivery is associated with the Council in Gloucestershire. The work is software supply rather than construction or a standalone advisory service. The contract has been extended with the original supplier, Tricostar, to maintain continuity while the Council prepares to procure a replacement system.

The procurement is complete and the contract is active. Gloucestershire County Council awarded the contract to Tricostar through a limited procedure without a prior competition; the stated basis was the need for additional services from the original contractor, since a change would raise technical and operational risks, disrupt integrated systems and risk missed court deadlines. The extension adds £74,076.28 to the original £369,000 contract value, bringing the recorded contract value to £443,076.28. The contract was signed on 1 November 2022. The Council decided to extend it for one year, with an option for a further year, up to two additional years in total. The modification is stated not to change the contract’s overall nature.

For suppliers considering similar future work with Gloucestershire County Council, this award indicates demand for legal case management software that supports court bundling and can integrate securely with the Council’s ICT environment. A credible competitor would need to demonstrate reliable handling and secure storage of legal documents, interoperability with existing systems and processes, and the ability to maintain continuity across legal, court and quasi-judicial workflows. The Council’s stated concerns also point to the importance of implementation planning that manages technical, operational and organisational change risks, alongside the capacity to meet statutory service deadlines. Suppliers should be able to evidence that they can support a complex, integrated local-government system and transition it without disruption; these are the capabilities that shaped the decision to retain the incumbent during the extension.

Legal Case Management System with Court Bundling Capability

Notice Description

This notice is to advise of a proposed contract modification. The Council has made the decision to extend the contract for a period of one (1) additional year, with an option to extend for an additional one (1) year again, up to a maximum of two (2) years. The contract will be varied increasing the value of the contract by PS74,076.28 (original contract value PS369,000). The increase to the value of the contract will rely upon: * Regulation 72(1) (b) for additional works, services or supplies by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor- 1. cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement, and 2. would cause significant inconvenience or substantial duplication of costs for the contracting authority, provided that any increase in price does not exceed 50% of the value of the original contract. The grounds relied upon to use Regulation 72(1)(b) are set out below: (a) A change of contractor within the required timeframe would create material technical, operational and local government re-organisation implementation risks due to the complex and integrated nature of the contract. (b) The technical capability to reconfigure the council's current systems and processes is another reason an extension is required to provide additional time to procure a replacement contract. The current system is fully integrated into the Council's ICT system to ensure that legal documents held within it are stored subject to robust security measures. (c) A change of contractor is not possible as a short-term measure and would result, in a potential failure to meet court and quasi-judicial deadlines thereby affecting the council's ability to deliver some of its statutory services, which extends beyond the statutory test of simple "inconvenience". (d) The proposed modification is necessary, proportionate, and compliant with Regulation 72(1)(b). It ensures continuity, avoids unnecessary cost and disruption, and maintains the integrity of the original procurement. (e) The increase in contract value arising from the proposed modification will not exceed 50% of the value of the original contract. (f) The modification will not alter the overall nature of the contract.
