Summary of the contracting process

Public Services Delivery Scotland, through the Common Services Agency, procured an interim supply of hygiene paper products for healthcare and workplace use. The products include toilet tissue, hand towels, facial tissues and couch rolls, supporting hygiene and infection prevention. They must work with the existing dispenser estate, which serves NHS Scotland sites. Delivery is in Scotland. This is a goods requirement for consumables rather than dispenser replacement: the immediate need is to keep the current dispensers supplied while NHS Scotland moves towards different supply arrangements. The products are used across healthcare settings, including a large, complex, multi-hospital environment, as well as workplaces. The requirement covers one lot of hygiene paper consumables.

The procurement is complete and the contract is active. Kimberly-Clark Professional was selected for the single lot under a limited negotiated procedure without prior publication of a contract notice. The stated reason was that the existing dispenser estate is owned by Kimberly-Clark and its position is that third-party consumables are not authorised for use in those dispensers; replacing the estate immediately was not considered operationally practicable. The contract was signed on 19 October 2026 and is valued at £19.6 million. Its stated interim term is 12 months, with an option to extend for up to a further 12 months to support transition. The future requirement is to be competitively procured through a separate process. No award scoring basis is stated.

For suppliers assessing similar future requirements from Public Services Delivery Scotland, this award indicates demand for dependable, large-scale supply of hygiene paper consumables across NHS Scotland. Credibility would depend on the ability to supply toilet tissue, hand towels, facial tissues and couch rolls suitable for the dispensers in use, while maintaining continuity across a complex, multi-hospital estate. The immediate arrangement was awarded to the incumbent because its dispensers were not considered compatible with third-party consumables and rapid replacement was judged impracticable. Competing for a later requirement would therefore call for a solution that addresses dispenser compatibility and transition, alongside the capacity to serve healthcare and workplace environments and support hygiene and infection prevention. The stated route for the future requirement is competitive procurement.

Procurement Information

The Common Services Agency known as Public Services delivery Scotland intends to award an interim contract to Kimberly-Clark Professional using the Negotiated Procedure without Prior Publication under Regulation 33(1)(b)(ii) of the Public Contracts (Scotland) Regulations 2015. The existing hygiene paper dispenser estate across approximately 1,000 NHS Scotland sites is owned by Kimberly-Clark and their position is that third-party consumables are not authorised for use within its dispensers. While there is wider market competition for hygiene products and replacement dispensers, the contracting authority does not consider the immediate or parallel replacement of an estate of this scale to be operationally practicable across a large, complex and multi-hospital environment over the next 12 months. National Procurement must maintain continuity of supply while a new competitive tender is completed and any transition to new supply arrangements is planned and implemented. In practice, this requires continued access to Kimberly-Clark products for use in the existing dispenser estate during the interim period. The award is therefore a temporary transitional arrangement for 12 months, with an option to extend for up to a further 12 months where required to support transition. The future requirement will be competitively procured through NP50827, enabling NHS Scotland to transition away from reliance on the existing incumbent-owned dispenser estate. The contracting authority therefore considers a time-limited award to Kimberly-Clark to be the only presently deliverable solution identified for maintaining continuity of supply while the competitive procurement and transition are completed.
