The City and County of Swansea (the Beach Operator) wishes to appoint the Royal National Lifeboat Institution ('RNLI') to provide a lifeguard service on beaches within the City and County of Swansea for the period 01 April 2024 to September 2028. Beaches are at Langland, Caswell and Port Eynon.

Procurement Information

The City and County of Swansea (the Council) are the beach operator of beaches at Langland, Caswell and Port Eynon. The Council is required to provide lifeguard services within those beaches from April to September each year and wishes to appoint the Royal National Lifeboat Institution (RNLI) for the period of 1 April 2024 to September 2028. It is the Council's position that it has a sufficiently detailed knowledge of the market to make the assessment that the RNLI are the only provider of these services and on this basis, the Council can meet the requirements of Regulation 32(2)(b)(ii) which permits the use of the negotiated procedure without prior publication to award public service contract where competition is absent for technical reasons. The RNLI provide these services on a nationwide basis and are the only specialist operator of the services who can meet the Council's requirements for this contract due to their expertise and experience, which is not offered by any other provider. Regulation 32(2)(b)(ii) applies where there is no reasonable alternative or substitute and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement. The Council has considered the market and there are no reasonable alternative providers who can provide the services with the level of expertise required. The absence of competition is due to the RNLI's position as a nationwide charitable organisation set up solely to provide these services and has such there is no artificial narrowing down of the parameters on the part of the Council.
