Other media has insufficient readerships and circulations in reach to the Swansea community: hence the larger amount is spent annually with the South Wales Evening Post (SWEP) It is the Council's position that other media has insufficient readerships and circulations in reach to the Swansea community to make the assessment that the South Wales Evening Post (SWEP) are the only provider of these services and on this basis, the Council can meet the requirements of Regulation 32(2)(b)(ii) which permits the use of the negotiated procedure without prior publication to award public service contract where competition is absent for technical reasons. Regulation 32(2)(b)(ii) applies where there is no reasonable alternative or substitute and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement. The Council has considered the market and there are no reasonable alternative of providers with the sufficient readerships and circulation required and as such there is no artificial narrowing down of the parameters on the part of the Council. The Council will hold a standstill period in accordance with Regulation 87.
