Under Regulation Reg. 6(d) of the Procurement (Scotland) Regulations 2016, a contracting authority may award a contract without competition based on following justification: i. Where it is for new services consisting of the repetition of similar services performed by the supplier to which the University awarded an original contract, provided that such services are in conformity with the basic project for which the original contract was awarded; ii. The award indicated the extent of possible additional services and the conditions under which they would be awarded; iii. The possible use of this procedure was disclosed in the Procurement Documents and the total estimated cost of subsequent services was taken into consideration by the University when applying the thresholds in relation to the original contract; and iv. Not more than three years have elapsed following the conclusion of the original contract. PTS were originally engaged via a mini tender - MT0623 Network Strategy Consultancy. The Mini Tender documentation provided for a phased approach: 'Two phases of work are anticipated: - Phase 1 will be to review our current network provision and make recommendations for the way forward. - This will potentially be followed by Phase 2, which will be to assist with a subsequent procurement of network equipment to address the most pressing deficiencies.' It was clearly stated that 'Following the acceptance by the University of the Phase 1 report, the University may elect to proceed with a procurement based on the report's findings. We may wish to appoint the same consultant to assist with that procurement.' This contract was awarded in June 2016,thus satisfying the requirement that no more than 3 years have elapsed since the original requirement
