The original contract was one of five contracts which were set up to contribute to the delivery of XPONorth. Each of the four contracts had an optional 1 year extension clause built into it. Four of the contracts are not being renewed for reasons a diligent contracting authority could not have foreseen and reasons outwith our control. In order to ensure XPONorth 2018 can proceed we are in a position where we have to modify one of the contracts originally awarded to deliver some elements of the four contracts which are not being extended to ensure the successful deliver of the event in 2018. HIE has modified this contract in compliance with Public Contracts (Scotland) Regulations 2015 Reg 72(1)(b) and (c): A contract and framework agreement may be modified without a new procurement procedure -- b) to provide for additional works, supplies or services by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor-- (i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial procurement; and (ii) would cause significant inconvenience or substantial duplication of costs for the contracting authority, provided that any increase in price does not exceed 50% of the initial contract value; (C) A contract and framework agreement may be modified without a new procurement procedure -- where all of the following conditions are fulfilled-- (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (ii) the modification does not alter the overall nature of the contract or framework; (iii) any increase in price does not exceed 50 % of the initial contract value or framework agreement; The value stated in VII.1.6 is the new total value for this contract including the extension period until 30 September 2018. The start date in VII.1.5 is the start date of the extension period (contract originally started in 2014).
