Scope of this Framework is the supply and delivery of rigid endoscopes and associated accessories, light cables, Endoscopic video camera systems and maintenance and repair to all entities constituted pursuant to the National Health Service(Scotland) Act 1978, (i.e. All NHS Scotland Health Boards, Special Health Boards and the Authority) Including but not limited to: Arthroscopes, Bronchoscopes, Cystoscopes, ENT Scopes, Oesophageoscopes, Hysteroscopes, Laparoscopes,Laryngoscopes, Resectoscopes, Arthroscopes, Flexible fibre scopes, Sheaths and Obturators. Quality management systems - Bidders shall provide evidence in the form of certification to verify certification to ISO 13485:2016 Medical Devices, Quality Management Systems or equivalent. 2) EU Medical Devices Directive (93/42/EEC) - Bidders shall confirm and demonstrate that their organisation complies with EU Medical Devices Directive (93/42/ECC) and evidence that all tendered products are CE marked in compliance with the directive. 3) EU Regulation on Medical Devices 2017/745 - Bidders shall confirm their organisation will commit to comply of the requirements of EU Regulation on Medical Devices 2017/745 from the 25th May 2020. 4) Medical Industry Accredited (MIA) service - Bidders shall confirm that staff who will be assigned to work on the framework will be members, or commit to gain membership prior to the framework start date, of the Medical Industry Accredited (MIA) service which will allow NHS Scotland staff check the credentials of visiting staff to ensure they are properly qualified to enter sensitive areas within a hospital. Please note: some Health Boards may also use other accreditation schemes and suppliers will be required to gain membership of these schemes to gain access to clinical areas within these Health Boards 5) Delivery Period - It is our expectation that any successful Bidder would be able to make deliveries within a maximum of 2 weeks from receipt of an order. 6) Geographical Area - Bidders shall confirm and evidence organisations ability to provide both training and technical support for all constituent Health Boards of NHS Scotland including the Highlands and Islands. 7) Availability of Spare Parts and Technical Support - Bidders shall confirm that they make available for purchase by the Participating Authority or its agents, any spare parts and components to ensure that the Goods can be maintained in safe working operation for a period of not less than 7 years from purchase and shall use reasonable endeavours to make such spare parts and components available to ensure that the Goods can be maintained in such safe working operation for a further period of three years after expiry of the said seven - year period. Such spare parts and components must be made available irrespective of whether or not the Participating Authority has a maintenance agreement with the Contractor. 8) End of support - Bidders shall confirm that all customers will be notified in writing of end of support dates and a reminder will be issued 2 years prior to the end of support date. 9) Business Continuity Planning - The Bidder shall ensure that they can provide the products and/or services specified within this tender, throughout the agreement period. To ensure that they can achieve this, Bidders are encouraged to develop, and regularly review, an appropriate business continuity plan. The business continuity plan should address all foreseeable circumstances that would affect the daily operation of the provision of products and/or service as appropriate. "reviewDetails": "The Authority will notify economic operators who submitted a tender or (where no deselection process haspreviously been made) applied to be selected to tender, of its decision to award the Framework Agreementwhich notification will contain, among other information, a summary of the reasons as to why the economic operator was unsuccessful. The notification will incorporate a 'standstill period' of a minimum of 10 (ten) clearcalendar days (or a minimum of 15 (fifteen) if the communication method used is not electronic) between the date on which the Authority despatches the notice(s) and the date on which the Authority proposes to conclude the relevant Framework Agreement. The bringing of court proceedings against the Authority during the standstill period will automatically continue the prohibition on entering into the Framework Agreement untilthe court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to anend the prohibition. The remedies that may be awarded by the courts before the Framework Agreement has been entered into include the setting aside of the decision to award the Framework Agreement to the winning tenderer(s). The bringing of court proceedings against the Authority after the Framework Agreement has been entered into will not affect the Framework Agreement unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2015 can be established. Otherwise the remedies that maybe awarded by the courts where the Framework Agreement has been entered into are limited to the award of damages.",
