The Tenant Farming Commissioner is responsible for promoting and encouraging good relations between landlords and tenants. Experience of the Tenant Farming Commissioner's casework to date demonstrates that there may be a minority of cases in which the parties involved have reached a point where their relationship is so poor that the issues they seek to be brokered cannot be aided by the Tenant Farming Commissioner, or resolved by submitting an inquiry into an alleged breach of a code of practice. The Scottish Land Commission would like to pilot a mediation service for landlords and tenants, in specific cases, where the relationship has broken down, where mediation can be considered in the public interest, and where both parties are willing to engage with each other to explore the best opportunities for reconciliation.

Tenant farmers and landlords involved in a dispute know that it can be overwhelming and difficult to find an acceptable outcome. This can lead to, or exacerbate, problems in maintaining strong and constructive relationships important to the tenant farming sector. Our experience of casework to date demonstrates that it is often more productive to address issues early in a dispute rather than encourage a formal inquiry to be lodged which must be investigated as an alleged breach of a code of practice, as defined under the Land Reform (Scotland) Act 2016. In a minority of cases, the parties involved have reached a point where their relationship is so poor that the issues they seek be brokered cannot be aided the TFC, or resolved by submitting an Inquiry into an alleged breach of a code of practice. Scottish agricultural holdings legislation is complex, and the Land Court is the ultimate decision maker when things go wrong. However, SLC would like to promote the use of mediation in the agricultural sector and has recently produced a Guide to Alternative Dispute Resolution. To further demonstrate the benefits of mediation, SLC wishes to pilot a mediation service for landlords and tenants where the relationship has broken down and where mediation can be considered in the public interest. SLC wishes to appoint a mediation service provider to oversee, administer and structure each mediation case referred to them by the Scottish Land Commission. As part of the tender bid, the successful mediation service provider shall outline the service provision in full detailing: resourcing; how the mediation service will be structured; the processes to be put in place to ensure delays are minimised; how any conflict of interest will be mitigated; and the formality around the conclusion of the process in different scenarios. It is essential that there is consistency in overall administration, resources and delivery, and the maintenance of high standards and overall quality.
