Procurement Information

It is considered that the variation of the existing contract and the award of a new contract in the circumstances detailed in this Paper is consistent with Regulation 32 (1) and (2) (b) (ii) and (iii) of the Public Contracts (Scotland) Regulations 2015, which allows the contracting authority to award a contract without a competitive process when for technical reasons or for reasons connected with the protection of exclusive rights, including intellectual property rights, a public contract may be awarded only to a particular economic operator. Cellebrite Limited is the owner of the systems software and therefore the only entity that can license and provide support and maintenance services for the systems.
