Any Bidder that received a score of Zero for one or more Technical criteria was excluded from the tender. Any bidder that received a total Technical score below 45% out of 100% was excluded from the tender. Community Benefits were not be included as part of this contract. The value is under regulated and a number of the Bidders were SMEs therefore it was not been deemed proportionate for this contract. Forestry and Land Scotland (FLS) may modify the Contract, irrespective of the monetary value of those modifications, within the scope permitted as allowed under Regulation 72 (1) of The Public Contracts (Scotland) Regulations 2015, should Operational reasons require it; -requirement for exceptional marketing costs out with stated anticipated budget, where agreed with the FLS; -additional days required due to unforeseen circumstances such as land disputes and the need for legal involvement; and -requirement for additional days due to lack of interest from the market, which has not been caused by either parties approach to the service. Non of the economic operators were deemed to be in situations as referred to in regulation 58 of the PublicContracts (Scotland) Regulations 2015 and therefore no bidders were excluded based on this regulation.
