Procurement Information

This contract is awarded under Regulation 33(1)(c) of the Public Contracts (Scotland) Regulations 2015 (the "Regulations"). For reasons of extreme urgency brought about by events unforeseeable by HES, the time limits for open procedure, restricted procedure or competitive procedure with negotiation cannot be complied with. HES conducted a procurement under the Regulations in 2018 for a new Corporate Management Information System (CMIS) and a separate procurement for an implementation partner to help scope and build the requirement. The contract with the original implementation partners required to be terminated with immediate effect as a consequence of events which were unforeseeable by HES and which were not attributable to HES. The CMIS requires to be implemented in accordance with a highly time-sensitive programme containing a number of time bound key milestones. As a direct consequence of termination of the contract with the original implementation partners, it is strictly necessary for HES to enter into a contract for a new implementation partner as a matter of urgency in order to ensure timely implementation of the CMIS, a business-critical system integral to: continued delivery by HES of its statutory functions of investigating, caring for and promoting Scotland's historic environment; and management by HES of its collections as a national resource for public reference, study and research, all of which is in the national public interest. In light of the extreme urgency in this case, the time limits for conducting an open procedure, restricted procedures or competitive procedure with negotiation cannot be complied with. Accordingly, following a negotiated procedure without prior publication in which three prospective suppliers were invited to participate, HES has decided to award a contract to Grant Thornton UK LLP under Regulation 33(1)(c) of the Regulations.
