Project Management - Carbon sequestration opportunities in Argyll and Bute
Notice Description
This contract award notice is being published as the contract, procured via the Quick Quote process, has been modified and is now over the GBP 50,000 threshold. Note, the "contract award without prior competition" template was selected for technical reasons - the original contract was tendered selectively. This contract is funded by the Community Renewal Funding (CRF). It was awarded in December 2021 with a start date of 10 January 2022 and expiring on 30 June 2022 with the option to extend until 30 September 2022. At the time of the award, the extension period was expected to be time only and it was not envisaged that there would be an opportunity to invoke it due to strict project timescales. See the Additional Information section for the explanation for the budget modification. The value in II.1.7. reflects the modified contract total value (up to 30 September 2022).

Lot 1
This is a contract modification for a contract currently in delivery on the CRF funded Carbon sequestration for Community Wealth Building project, which HIE is delivering under a contract to Argyll and Bute Council (ABC). This specific contract is for project management of six separate work packages, requiring five different procurement exercises, including stakeholder management groups and other related tasks. The UK Government approved a project extension by three months from an initial delivery period of six months (the original project was intended to run from start January 2022 to end of June 2022) Although HIE allowed for a potential 3-month extension at the time when the Quick Quote was published, this was only envisaged to be extension of time only and a potential extension of the project delivery timescales was still considered unlikely due to strict stipulations of delivery timescales as per our contract with ABC. The original contract award was delayed due to awaiting the funding decision which had a severe impact on the amount and frequency of services required. This and other factors have already resulted in some more intensive and additional project management services required from the supplier (e.g. difficulties of getting a supplier for the other work packages). In order to successfully complete the project, achieving all outputs, HIE needed to modify the current contract with Imani Enterprise Limited both in terms of timescales (requiring the additional three months extension) as well as budget (requiring GBP 21,875 additional budget). The modified contract total is GBP 65,625 with the revised expiry date of 30 September 2022. As the new contract value exceeds GBP 50,000, HIE is publishing this contract award notice. Explanation Please explain in a clear and comprehensive manner why the award of the contract without prior publication is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the Regulations: HIE's best estimate was that the required services will not exceed GBP50k, hence a Quick Quote process was conducted. HIE bid for the CRF funding with some assumptions, using the information available to us at the time-the delay in getting the funding decision and the extension of the project timescales were unforeseen.A number of unexpected challenges required additional effort from the supplier:the shortening of the delivery period (start delayed by 6 to 7 months; the end extended by less, only 3 months) compressed delivery and put more demands on its management than anticipated.Further complexity became apparent when HIE experienced challenges to secure a supplier for the work packages and required additional services from Imani Enterprise Limited to secure a suitable supplier. We have modified this contract to enable a successful completion of the project in line with the principles of the Public Contracts (Scotland) Regulations 72(1)(b) and (c) of the Public Contracts (Scotland) 2015: It is key that HIE receives project management support from the same supplier: Imani Enterprise Limited is currently delivering the services and they are not readily interchangeable; it would not be practical to change/add a new supplier at this stage as it would cause significant inconvenience and even substantial duplication of costs. This is a complex project within a relatively new market (carbon sequestration) and the project timescales are still very tight. HIE used their best estimate at the time, enabling us to proceed with the project according to the timescales we were advised-the funding decision was delayed considerably by the UK Government, and this was out of HIE's control. The contract modification takes the contract value over the threshold for regulated tenders, however the additional value does not exceed 50% of the original contract value and the overall nature of the services has not been altered.
