Notice Description

The Council requires the continuation of its Geographical Information System (GIS), which operate on desktop server and mobile platforms to deliver data driven knowledge to all sectors and levels of the Council. The Council relies upon the GIS software to deliver geospatial services to citizens and external partners including mapping applications on our public website, vehicle routing functionality and gritter tracking while third parties use the mapping software for information and progress reporting on projects such as gully cleaning operations and the installation, commissioning and deinstallation of Christmas lights.

This procurement for this Contract was conducted as a negotiated procedure in accordance with Regulation 33 (1)(b) (iii) of the Public Contract (Scotland) Regulations 2015 which states that "a contracting authority may award a public contract following negotiated procedure without prior publication of a contract notice or prior information notice in any of the following cases-- (iii)the protection of exclusive rights, including intellectual property rights but only, in the case of paragraphs (ii) and (iii), where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.

Procurement Information

The Council seeks to negotiate directly with ESRI due to the following: - No other supplier can provide the integrated applications the Council currently uses with ArcGIS. Replacing the platform would require several separate contracts to replicate the functionality. - ArcGIS technology is embedded in numerous key operational processes and replacing these would cause significant disruption. GIS services are identified as critical in the Council's Business Continuity Plan and any change would require significant risk management to ensure key capabilities are not disrupted. - Esri products have been customised and developed over a significant period to meet operational needs and this development work would have to be repeated in any new platform. It would also not be possible to reproduce the level of integration and efficiency we can achieve with ArcGIS - Not only does the platform have customisations at the organisational level but it can and has been developed to meet the needs of multiple specific groups of users. -Several ongoing transformation projects have Esri products as key components - replacing these products with other solutions would cause significant delay and restructuring of these projects.
