Summary of the contracting process

The Aberdeen City Council has awarded a short-term emergency contract for the operation and maintenance of the Energy from Waste Facility located in Aberdeen City. This contract was necessitated due to the unforeseen termination of a previous arrangement and aims to provide continuity of service while a long-term solution is sought. The procurement process, governed under the 2015 Regulations, utilised a limited award procedure without prior publication owing to the extreme urgency of the situation. The contract was awarded to SUEZ Recycling & Recovery UK, reflecting the completion stage of the procurement. The services include general public services in the waste management sector, specifically identified under CPV codes such as 90513300, and the contract involves handling approximately 227,000 homes and 6,500 businesses across council areas including Aberdeenshire and Moray. This emergency arrangement commenced on 26th January 2026 and is valued at £18,000,000, with an optional extension up to six months.

This tender presents opportunities for large-scale waste management enterprises capable of delivering essential operations under tight deadlines in response to urgent needs. The need for skilled operators in compliance with environmental and safety regulations is critical, indicating suitability for businesses experienced in energy recovery or similar service sectors with specialised capabilities in waste management and facility operations. It allows businesses to demonstrate their adeptness in emergency response situations and establish partnerships with governmental authorities, such as Aberdeen City Council, which could lead to further engagements or expansion in public infrastructure services. Businesses experienced in providing such vital services under pressing conditions may find this contract a stepping stone to expanding their presence in regional waste management projects.

Lot Information

Lot 1

The Authority requires a short-term emergency contract for the operation and maintenance of the Energy from Waste Facility in Aberdeen. The Contractor will be responsible for providing the day-to-day operation of the facility, handling and processing of waste and providing maintenance of the plant and equipment. This contract is being put in place to ensure continuity of service following the termination of the previous contractor and will remain in effect only until a longer-term operational Contractor is procured by the Authority.

Options: Yes, optional extension of up to 6 months.

Procurement Information

The Emergency Operation and maintenance contract is strictly necessary due to the extreme urgency brought about by the termination of the previous contract for the operation and maintenance of the Energy from Waste Facility in December 2025. The Council was not responsible for the events that led to that termination, nor was the termination foreseeable. That contract provided for a termination notice period of 20 Business Days. That was insufficient to comply with any of the time limits for open procedure, restricted procedure, or competitive procedure with negotiation, particularly for something as complex and onerous as operation of an Energy from waste facility. The shut-down of the Facility and absence of any agreement to resume operation represented serious health and safety, environmental, and commercial risks to Aberdeen City Council, Aberdeenshire Council and the Moray Council. The Facility provides a critical waste disposal function for all of these council areas. It serves around 227,000 homes and approximately 6,500 businesses. It enables the Councils to discharge their statutory duties under the Environmental Protection Act 1990. The defenders have also expended very substantial sums in constructing the Facility. They have a clear and obvious interest in ensuring that it is properly preserved and maintained. There is otherwise a very real risk that public funds will be wasted. The duration of the emergency operation and maintenance contract is only for the period that is strictly necessary to allow for a procurement of a replacement operator for the Facility, on a longer term basis, using the appropriate procedures under the 2015 Regulations.
