The National Waiting Times Centre Board (Golden Jubilee) intends to enter into a contract with ADT Fire and Security plc as the only supplier capable of meeting the Board's requirements. In accordance with our interpretation of the Public Contracts Regulations 2015, the required services can only be provided by a particular operator for technical reasons. The requirement is specifically for the provision of planned preventative maintenance, reactive maintenance, technical support and repair services for the existing Golden Jubilee Hospital & Golden Jubilee Conference Hotel fire detection and alarm systems. The National Waiting Times Centre Board (Golden Jubilee) is satisfied that ADT Fire and Security plc is the only provider capable of meeting the Board's requirements for the existing fire detection and alarm systems installed across the site. The existing fire detection and alarm system installed across Golden Jubilee Hospital and the Golden Jubilee Conference Hotel is a proprietary ADT closed-protocol system forming part of a life-safety critical infrastructure network. ADT is the only supplier with authorised access to the proprietary software, programming tools, configuration data and network integration functions required to deliver the full maintenance, repair and support service. No reasonable alternative or substitute exists, as any change of provider would require replacement of substantial elements of the existing infrastructure or create an inability to access essential programming and support functions, resulting in disproportionate cost, significant operational disruption and risk to continuity of a critical safety system. Accordingly, the Board considers that the conditions of Regulation 33(2)(b)(ii) of the Public Contracts (Scotland) Regulations 2015 are satisfied.
