Summary of the contracting process

Wiltshire Council led a regional procurement for independent disagreement resolution, mediation advice and mediation services relating to special educational needs and disabilities. The services were intended to support duties under the Children and Families Act 2014, the SEN and Disability Regulations 2014 and the SEND Code of Practice 0-25. Wiltshire was procuring on behalf of Cornwall, Bath and North East Somerset, Bristol, Devon, Dorset, Gloucestershire, the Isles of Scilly, North Somerset, Plymouth, South Gloucestershire, Somerset, Swindon and Torbay. Delivery covered the participating South West local authorities. Collis Mediation Limited was selected for an award valued at £2,255,250 excluding VAT (£2,706,300 including VAT), with a contract period from 1 September 2026 to 31 August 2029 and potential one-year-plus-one-year extensions to 31 August 2031. However, the award and procurement were cancelled on 21 July 2026 because the Council decided it was not in the public interest to continue and terminated the process.

For a future requirement of this type, credible suppliers would need demonstrable expertise in independent SEND disagreement resolution, mediation advice and mediation for children, young people and families. They would need to understand the Children and Families Act 2014, the SEN and Disability Regulations 2014 and the SEND Code of Practice 0-25, and be able to deliver consistently across multiple South West local authorities. The competition attracted five bids, including four from SMEs, indicating that specialist smaller providers can compete for this regional model. Strong capability would include qualified and experienced mediators, reliable case management, impartial advice, safeguarding awareness, sound reporting and the capacity to coordinate a service across a broad public-sector geography while maintaining accessible support for families and education settings.

Wiltshire Council is seeking a provider who can deliver independent disagreement resolution, mediation advice and mediation in accordance with the Children and Families Act 2014, the SEN and Disability Regulations 2014 and the SEND Code of Practice 0-25. A group of Local Authorities in the southwest region have agreed to participate in regional arrangements for the provision of disagreement resolution, mediation advice and mediation services ("the Services"). Wiltshire Council ("the Lead Authority") will lead the procurement for the Services on behalf of the other participating Local Authorities.
