Summary of the contracting process

Bath & North East Somerset Council is in the planning stage for a significant highways maintenance and improvement project, with the process initiated as a tender. The Council, a public authority within the sub-central government category, is based in Bath, UK. They have announced an Early Market Engagement exercise as part of their reprocurement strategy, aimed at informing the future scope and structure of the Highway Term Maintenance Contract (TMC), expected to commence in April 2029. This engagement phase, scheduled with key activities to be completed by 5th August 2026, seeks feedback on several areas including alternative contract scopes and risk allocation. The procurement focuses on works relating to construction and maintenance services, particularly in region UKK1, with legal proceedings conducted under the 2023 Procurement Act. Future communications about the tender are anticipated by 1st September 2027.

This tender offers a unique growth opportunity for businesses specialising in construction and maintenance services related to roads and infrastructure. SMEs in particular are encouraged to engage and provide insights during this preliminary market engagement phase, as it will help shape a tender that is both manageable and advantageous. The attention given to market feedback implies that businesses with innovative approaches to contract scope, commercial implications, and delivery models could potentially gain a competitive edge. Additionally, suppliers and contractors capable of delivering comprehensive, value-added services in highway maintenance and improvements would be well-positioned to compete for this contract, providing sustainable business growth until at least 2036, with the potential for renewals extending further.

Highways Maintenance and Improvement

Notice Description

Bath & North East Somerset Council ("the Council") is undertaking an Early Market Engagement exercise in advance of the reprocurement of its Highway Term Maintenance Contract (TMC) in accordance with the Procurement Act 2023, which is anticipated to commence in April 2029. The purpose of this engagement is to inform the Council's approach to the scope, structure and packaging of the future contract, test market appetite and capacity, understand the commercial and operational implications of potential service delivery models and ensure the future arrangements are attractive to the market, being deliverable and capable of providing value for money. The Council currently delivers a comprehensive highways service through a term maintenance arrangement covering routine and reactive maintenance, planned preventative maintenance, surfacing works, small improvement schemes, drainage, structures and associated highway assets.

Planning Information

As part of its reprocurement strategy, the Council is considering a range of future delivery models. The Council is therefore inviting interested suppliers, contractors and market participants to complete an Early Market Engagement Questionnaire. The questionnaire seeks feedback on: • Market appetite for alternative contract scopes; • Commercial implications of different packaging arrangements; • Delivery and integration risks; • Contract structure and risk allocation; • The future treatment of street lighting services; and • Any other matters that may assist the Council in developing its future procurement strategy. Responses will be used to inform the Council's preferred delivery model, future procurement strategy and the scope and structure of the future contract. The Council may undertake follow-up discussions or clarification meetings with respondents as part of the engagement process. PME exercise can be found on ProContract/Supplying the South West: https://www.supplyingthesouthwest.org.uk/, project ID DN822367 Participation in this engagement exercise is entirely voluntary and is intended solely to assist the Council in understanding market views. This notice and the associated questionnaire do not constitute a call for competition, invitation to tender, or commitment to undertake any procurement. Participation will not confer any advantage in any future procurement process.
