Summary of the contracting process

The London Borough of Hammersmith and Fulham is procuring an environmental enforcement service. The requirement concerns enforcement against environmental offences and related antisocial behaviour, including issuing and processing fixed penalty notices, managing appeals and debt recovery, handling enquiries, and providing administration, reporting and management oversight. The Council may also require enforcement under additional or varied Public Spaces Protection Orders, with associated changes in staffing, training and operational activity. This is a single-lot service requirement, classified as environmental services (CPV 90700000). Delivery is in the United Kingdom; no more specific delivery area is identified in the procurement details. The Council’s detailed service requirements are set out in the procurement specification documents.

The Council invited offers through an open competition under the Procurement Act 2023. This is the tender stage. The deadline for clarification questions was 28 October 2027 at 17:00; bids were due by 4 November 2027 at 12:00. The contract is expected to run from 1 February 2027 to 31 January 2029, with two possible 12-month extensions at the Council’s discretion, giving a maximum period to 31 January 2031. The estimated value is £2,653,000 excluding VAT (£3,183,600 including VAT), including the potential extensions. There is one lot, considered suitable for SMEs. Evaluation is weighted 40% on technical quality and 60% on price. The Council assesses legal, financial and technical participation conditions; annual turnover must be at least twice the published annual contract value relevant to the bid.

The opportunity suits suppliers able to deliver environmental enforcement and manage the associated operational and administrative workload. Relevant capability includes deploying and supporting enforcement officers, training staff, processing fixed penalty notices, handling appeals and debt recovery, responding to public enquiries, and maintaining management oversight and data reporting. Suppliers should be able to adapt staffing and delivery as enforcement volumes, Council priorities or Public Spaces Protection Orders change. The Council’s assessment covers legal and financial capacity as well as technical ability. Bidders must meet the stated turnover threshold, and the Council may conduct credit checks on the preferred supplier, consortium members and significant subcontractors before award. The lot is identified as suitable for small and medium-sized enterprises, so capable SMEs may compete, subject to satisfying the participation conditions and demonstrating a technically credible delivery approach.

Lot Information

Lot 1

Options: The Council has considered paragraph 5, Schedule 8 of the Procurement Act 2023 (UKPGA 2023/54) and identified an indicative suite of potential known risks that may materialise and in doing so may jeopardise the satisfactory performance of the Contract but, which due to their nature, are unable to be addressed in the Contract as awarded. Where the relevant conditions under paragraph 5, Schedule 8 of the Procurement Act 2023 (UKPGA 2023/54) are satisfied, the Council may make a future modification of the Contract to remedy the risks, as a permitted contract modification. For this procurement, Known Risk risks, which may materialise, and which are not otherwise already provided for in the Contract include but are not limited to the indicative suite of potential risks set out in Table D, below. This list must not be considered as exhaustive, and the Council reserves the right to amend the list during the course of the procurement process (In the event that it does so, all Potential Suppliers will be notified). It should also be noted that there may be further risks identified within the Contract term which are subject to permissible modification under other parts of Schedule 8 of the Procurement Act 2023 (UKPGA 2023/54). Potential Suppliers are reminded that consideration of the materialisation of any known risk, or any other reasons for potential modification of the Contract will not be accepted as a reason to change the risk share in the Council on the pricing, or otherwise. Known Risks Which May Materialise (Paragraph 5, Schedule 8 of the Procurement Act 2023 (UKPGA 2023/54)) and/or Other Risks Which May Arise and Require a Contract Modification Under Schedule 8 of the Procurement Act 2023 (UKPGA 2023/54), Other Than Paragraph 5 Known Risk 1. Introduction of Additional Public Spaces Protection Orders The Council may introduce new Public Spaces Protection Orders (PSPOs) during the term of the Contract or may vary existing PSPOs to address emerging environmental crime or anti-social behaviour issues. The introduction of additional PSPOs could significantly increase enforcement activity, staffing requirements, training requirements, administration, data reporting, and management oversight. The extent of any increase cannot be accurately quantified at the commencement of the Contract. The Council is unable to determine at this stage whether additional PSPOs will be required, the nature of any future restrictions, the geographic scope of such PSPOs, or the corresponding enforcement demand. Should this risk materialise, the Council reserves the right to modify the Contract to reflect changes in service requirements, staffing levels, performance measures, operational arrangements, and/or contract value. 2. Significant Increase in Fixed Penalty Notice (FPN) Volumes The volume of environmental offences and resulting FPNs may exceed forecast levels during the Contract term. This could result in additional officer deployment, increased administrative processing, appeals management, debt recovery activity, reporting requirements, and customer enquiries. Actual levels of offending, compliance rates and enforcement demand are influenced by external factors and cannot be reliably predicted throughout the Contract term. Should enforcement activity substantially exceed initial assumptions, the Council may seek to modify the Contract to ensure sufficient resources are available to maintain service performance. 3. Changes in Enforcement Priorities Emerging environmental issues, resident concerns, legislative changes, or strategic priorities may require enforcement resources to be redirected and/or expanded. The Council cannot accurately predict future environmental crime trends or community concerns over the life of the Contract and therefore may modify the Contract Scope, performance framework, specification, or resource requirements where necessary.

Renewal: Option to extend by 2 years (1+1) at Councils discretion
