Procurement Information

The contract commenced on 16th October 2023 for 24 months until 15th October 2025. The current contractor, Greenview Gas Ltd, intends to novate the contract to H&A Mechanical Services Ltd ('H&A'), or an alternative contractor to be determined in due course, with the consent of the NIHE, pursuant to clause 26.1 of the contract. As part of the novation, the NIHE intends to extend the service period of the contract by 52 weeks from the operable date of the proposed Deed of Novation. The necessity for this has arisen due to the inability of the incumbent contractor to complete their contractual obligations in a timeous manner. It has therefore become necessary for a new contractor to assume the contractual responsibility and complete the remaining work. As such, the service period needs to be extended by 52 weeks to allow H&A (or any other new contractor) sufficient time to complete the services thus ensuring essential service delivery for NIHE tenants. The modification is permitted under Regulation 72(1)(d). Also, the modification is permitted from the perspective that H&A satisfy all the requirements under the original procurement to qualify for award. Regulation 72(1)(d)(i) permits a contract modification where a new contractor replaces the one to which the contracting authority had initially awarded the contract as a consequence of an unequivocal review clause or option in conformity with Regulation 72(1)(a). Regulation 72(1)(a) permits modifications that, irrespective of their monetary value, have been provided for in the initial procurement documents in clear, precise and unequivocal review clauses, which (i) state the scope and nature of possible modifications or options as well as the conditions under which they may be used, and (ii) do not provide for modifications or options that would alter the overall nature of the contract or the framework agreement. This modification is permitted under Regulation 72(1)(d)(i) because the contract between the NIHE and Greenview includes an unequivocal review clause, namely clause 26.1 of the contract. Furthermore, pursuant to clause 26.1, the NIHE has consented to the novation. In addition, the proposed novation does not provide for modifications or options that would alter the overall nature of the contract. For example, the scope of the services will remain unaltered as will the overall value of the contract.
