Procurement Information

The Scottish Ministers consider that regulation 33(1)(b)(ii) of the Public Contracts (Scotland) Regulations 2015 allows for the negotiated procedure without prior publication of a contract notice or prior information notice in this case. The incumbent service provider is the only economic operator who can support and maintain the legacy Electronic Document and Records Management System (eRDM) which currently provides the Scottish Government with a business critical electronic filing system and document of record. The software application for eRDM is owned by the incumbent service provider. The vendor's business model and proprietary rights preclude support or maintenance of the system by third parties. Competition is therefore absent for technical reasons as the Authority requires on-going technical support and maintenance of this business critical application.
