Under Regulation Reg 6(1)(b)(ii of the Procurement(Scotland) Regulations 2016, a contracting authority may award a contract without competition based on following justification: Competition is absent for technical reasons (only if it is not caused by artificial narrowing down of the parameters of the procurement and no reasonable alternative or substitute exists) DEXA measurements were done using a Lunar iDXA on the University of Birmingham Research Bus, which was hired for the first study visits in May 2017. Unfortunately this machine will now not be available for forthcoming study visits. Future measurements must be made using the same type of scanner, since the variability between scanners is significant.
