It is considered that the renewal of the licence agreement with ESRI UK Limited for the ArcGIS Software for a further 3 year period in the circumstances detailed in this paper is consistent with Regulation 33(4)(b) of the Public Contracts (Scotland) Regulations 2015, which allows a contracting authority to award a public supply contract following negotiated procedure without prior publication in a case for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.
