Under Regulation 33(1)(b)(ii) of the Public Contracts (Scotland) Regulations 2015, a contracting authority may use the negotiated procedure without the prior publication in the case of a public contract, based on the following justification: Competition is absent for technical reasons (only if it is not caused by artificial narrowing down of the parameters of the procurement and no reasonable alternative or substitute exists).

Procurement Information

Market investigation of the compute server suppliers has shown none who provide equipment matching the technical requirements for our high density storage needs. Our data centre is space limited and requires a very rack dense configuration of network attached storage devices in order to meet our projected data volumes for the coming years. We also require our NAS devices to be independently managed (not JBOD type solutions) in order to ensure data/service silos for the various international projects we collaborate on which often have different service level agreements in regards to data hosting and service availability. This combination of high density storage on independent systems is relatively specialized, and falls outside the scope of most vendors whose focus is on storage area networks (SANs) or extended server with JBOD solutions, neither of which can meet our density limitations and management obligations.
