Procurement Information
Disclosure Scotland considers that Regulation 33 of the Public Contracts (Scotland) Regulations 2015 permits the use of the negotiated procedure without prior publication of a contract notice or prior information notice in this instance. Building maintenance services had been provided by the principal tenant of the premises for over 20 years. With the lease due to expire in May 2025, Disclosure Scotland was scheduled to vacate the building alongside the other tenant as part of a broader Scottish Government initiative to relocate to new premises. However, due to unforeseen delays in the relocation project, an urgent decision was made for Disclosure Scotland to remain in the premises as the sole occupant until the new location became available. Consequently, a short-term lease had to be negotiated with the landlord under very tight timescales. As the principal tenant was vacating the building, maintenance services were also set to cease, necessitating the urgent procurement of continued building maintenance services. Given the extreme urgency, Disclosure Scotland engaged the existing Scottish Government Soft and Hard Facilities Management (FM) supplier, who had been appointed through a competitive process. The contract was awarded on the same terms and conditions as the overarching Scottish Government FM contract. Its duration is strictly limited to the term of the current lease, aligning with the timeline for the Scottish Government's identification of new premises and Disclosure Scotland's subsequent relocation. This contract is appropriately constrained in duration, reflecting the critical and urgent nature of the required services, and ensuring a safe and effective transition and mobilisation of the new FM arrangements.
