Notice Description
Cheshire East Council is using the Light Touch Regime to source a number of providers to deliver a holiday activities scheme within easy access of families currently in receipt of Free School Meals in line with DfE (Department for Education), guidelines for this funding. The criteria of the DfE funding must be met by a suitable range of providers and the activities sessions must run for a minimum of 4 hours. Providers should provide a hot meal which could necessitate the use of sub-contracting. The DfE initiative enables Councils to coordinate a programme that provides eligible young people between the ages of 4 - 16 and up to age 25 if SEND applies, to receive healthy food and enriching activities during the Easter, summer and winter school holidays. The contract term will be for 15 months initially, with the option to extend by up to 12 months. All services will be operational from school holidays December 2022. The optional extension from 1st April 2024 - 31st March 2025 will be at the sole discretion of the Council, it will also depend on availability of continued funding. This opportunity is suitable for SME and VCSFE organisation (i.e. small - medium and the voluntary - charity, faith section). For the avoidance of doubt, the Contracting Authority points out that no weight will be attached to whether or not an economic operator is an SME/VCSFE organisation when selecting economic operators to submit tenders or in assessing the most economically advantageous tender.

The criteria of the DfE funding must be met by a suitable range of providers and the activities session must run for a minimum of 4 hours. Providers should provide a hot meal which could necessitate the use of sub-contracting. As per the title of this lot 'Main provision including SEND support if appropriate' this may or may not also include support for vulnerable children/young people, as specified; there is a detailed specification of requirements. It is anticipated that the total value of this Lot over the full time period including the optional extension should equate to between PS1,400,000 to PS1,800,000 with an average session price of PS12.50 being targeted.
Options: The 12 month optional extension from 1st April 2024 - 31st March 2025 will be exercised at the sole discretion of the Council. In the event contracts are extended any extension shall be on the same terms and conditions of contract as the original contract period.

"reviewDetails": "This procurement is being advertised under the Light Touch Regime (LTR). Contract awards will be made in line with the Light Touch Regime: https://www.legislation.gov.uk/uksi/2015/102/regulation/74/made per The Public Contracts Regulations 2015 The subject matter of this procurement process relates to the delivery of services which are listed to in Schedule 3 to the regulations. As such the full regime set out in the regulations will not apply to the award of these contracts. Consequently, the procurement process adopted by the Commissioners has been developed in accordance with Regulation 76 of the regulations and in particular in accordance with the fundamental public procurement principles of transparency and equal treatment. Cheshire East Council will incorporate a voluntary standstill period at the point information on the award of the contract is communicated to tenderers. That notification will provide full information on the award decision and as such will be used as review procedures. The standstill period, which will be for a minimum of 10 calendar days provides time for unsuccessful tenderers to review and scrutinize the award decision before the contract is entered into."
