The Scottish Government has a collaborative framework for goods and services provided by Supported Businesses which expires on 11 September 2017. The Public Contracts Directive 2004/18/EU was replaced by directive 2014/18/EC on 18 April 2016, changing the definition regarding Reserved Contracts. As a consequence of these legislative changes there has been a reduction in the required percentage of employees classified as disabled needed to qualify as a Supported Business (from 50% to 30%). The definition of companies which can bid for reserved contracts has also changed to include staff considered to be "disadvantaged" (not just disabled). Invoking a 12 month NCA has ensured continued access to the market for those supported factories and businesses who are on the current framework whilst: I. allowing the current and emerging markets sufficient time to respond to the new definitions under the new procurement directive; and, II. providing the Scottish Government with the time to engage with key stakeholders including potential suppliers, Centres of Procurement Expertise and public and private sector bodies, on the various potential route(s) to the market, the scope of goods and services likely to be procured, while still delivering value for money. It is therefore considered that under the circumstances the Public Contracts (Scotland) Regulations 2015 allow for the Award of a contract without prior publication of a call for competition to be utilised in this case. The framework contract will be extended for an 12 month period from 12 September 2016 to the 11 September 2018 using the Negotiated Procedure without competition. Estimated spend over the 12 month extension is GBP 590,000.
