                    "description": "The Gas Servicing & Maintenance Contract being modified contained provision for the annual, testing, replacing and installing of Heat Detectors, Smoke Detectors and Carbon Monoxide Detectors. Rates for the replacement of these items formed part of the procurement exercise. Glen Oaks is having to increasing the value of the contract to ensure that its properties meet the increased Tolerable Standard, recently introduced in February 2019 which requires linked smoke and heat detectors to be fitted in all social-rented properties by 2021. This entails of a greater number of installations or replacements of these items than was anticipated when the contract was procured and is in accordance with the Schedule of Rates provided under the contract. The Tolerable Standard was increased by the Scottish Government as a response to the Grenfell Disaster in 2017. This would not have been reasonably foreseeable by Glen Oaks at the time the contract was procured in 2015-16.",
                    "rationale": "Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee: The increase to the Tolerable Standard was not foreseeable at the time of the procurement of this contract. The decision to modify it therefore is justified on the following grounds as stated in the Public Contracts Scotland Regulations 2015 (Regulation 75): i) The need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; ii) The modification does not alter the overall nature of the contract or framework; & iii) Any increase in price does not exceed 50 % of the initial contract value or framework agreement."
